Education Terms

These Additional Terms for Education Accounts supplement SkyCiv’s General Terms of Service if you meet the Education Account Eligibility Guidelines and are using a SkyCiv Education Account (“Educational Institution”).

  1. To the extent applicable, you will obtain any necessary parent or guardian consent for a student or child to use the Platform prior to inviting a student to the use the Platform in accordance with applicable laws, including without limitation the Children’s Online Privacy Protection Act (“COPPA”).
  2. You will only use, and only permit your students to use the Platform, including through the use of a SkyCiv Education Account, (and all Third-Party Products and third-party code included, used in conjunction with or incorporated therein) for non-commercial, educational purposes.
  3. SkyCiv Education Accounts may only be used by an Educational Institution’s students, staff, and faculty.
  4. Students may only be invited to use SkyCiv Education Accounts by a Teacher and may use the Platform in that way so long as they are a student of the Educational Institution and under the supervision of a Teacher.
  5. By creating a SkyCiv Education Account, you confirm that you have read, understood and agree to our Data Processing Addendum in full, and that the Data Processing Addendum shall be incorporated into this Agreement to the extent Personal Data subject to the Applicable Privacy Laws (as defined in the Data Processing Addendum) is processed in your use of the Platform. In the event of any conflict between the SkyCiv General Terms of Service, these Additional Terms for Education Accounts and the Data Processing Addendum, the Data Processing Addendum shall prevail. This section shall not apply if you or your organisation has entered into a separate written agreement with SkyCiv pertaining to the processing of personal data.
  6. Clause 10 of the SkyCiv General Terms of Service (Limitations of Liability) shall be replaced with the following: IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOSSES, OR EXPENSES (INCLUDING BUT NOT LIMITED TO BUSINESS INTERRUPTION, LOST BUSINESS, OR LOST PROFITS) EVEN IF IT HAS BEEN ADVISED OF THEIR POSSIBLE EXISTENCE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. IN NO EVENT SHALL CANVA’S AGGREGATE CUMULATIVE LIABILITY UNDER THESE TERMS (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY IN TORT OR BY STATUTE OR OTHERWISE) EXCEED AU$100.
  7. Clause 11 of the SkyCiv General Terms of Service (Indemnification by Subscriber) apply only to the extent permitted by applicable law.
  8. For purposes of these Additional Terms for Education Accounts:

SkyCiv Education Account” means a User account on the Platform whose Plan Inclusions are designated for use by a students of Educational Institutions and which are administered by an Educational Institution, Teacher, parent or guardian as the Subscriber.

Teacher” means an individual who is working for an Educational Institution and whose primary role is teaching its enrolled students, or as otherwise defined in the Education Account Eligibility Guidelines.

“Education Account Eligibility Guidelines” means a recognised Educational Institution teaching Structural Engineering (or equivalent) and may include a University, High School or any other educational institution deemed eligible by SkyCiv. In detail, this may include

Accredited educational institutions such as universities, colleges, technical schools, and high schools
Faculty and staff using SkyCiv in official coursework or academic labs
Departments or programs focused on engineering, architecture, or construction education

However, may exclude:

Individual students or graduates without an official institutional license
Private training programs or bootcamps not affiliated with an accredited school
Commercial, government, or nonprofit organizations—even if conducting internal training
Freelancers or consultants using the software for personal skill development

On demand, institutions must provide:

    • An official school email address (e.g. .edu, .ac.uk)
    • A faculty contact for account administration
    • Documentation showing SkyCiv’s use in coursework or curriculum (e.g. syllabus, course outline)
